1. Relevant Legal Bases

Nach Maßgabe des Art. 13 DS-GVO teilen wir Ihnen die Rechtsgrundlagen unserer Datenverarbeitungen mit. Sofern die Rechtsgrundlage in der Datenschutzerklärung nicht genannt wird, gilt Folgendes: Die Rechtsgrundlagen für die Einholung von Einwilligungen sind Art. 6 Abs. 1 lit. a und Art. 7 DS-GVO sowie Art. 9 Abs. 2 lit. a und Art. 7 DS-GVO, die Rechtsgrundlage für die Verarbeitung zur Erfüllung unserer Leistungen und Durchführung vertraglicher Maßnahmen sowie Beantwortung von Anfragen ist Art. 6 Abs. 1 lit. b DS-GVO, die Rechtsgrundlage für die Verarbeitung zur Erfüllung unserer rechtlichen Verpflichtungen ist Art. 6 Abs. 1 lit. c DS-GVO, und die Rechtsgrundlage für die Verarbeitung zur Wahrung unserer berechtigten Interessen ist Art. 6 Abs. 1 lit. f DS-GVO. Für den Fall, dass lebenswichtige Interessen der betroffenen Person oder einer anderen natürlichen Person eine Verarbeitung personenbezogener Daten erforderlich machen, dient Art. 6 Abs. 1 lit. d DS-GVO als Rechtsgrundlage.

2. Änderungen und Aktualisierungen der Datenschutzerklärung

We ask you to inform yourself regularly about the content of our data protection declaration. We will adapt the data protection declaration as soon as the changes in the data processing we carry out make this necessary. We will inform you as soon as the changes require your cooperation (e.g. consent) or other individual notification.

3. Security Measures

3.1. In accordance with Art. 32 DS-GVO, taking into account the state of the art, the implementation costs and the type, scope, circumstances and purposes of the processing as well as the different probability of occurrence and severity of the risk for the rights and freedoms of natural persons, appropriate technical and organizational measures to ensure a level of protection appropriate to the risk. The measures include, in particular, securing the confidentiality, integrity and availability of data by controlling physical access to the data, as well as access, input, transfer, securing availability and their separation. Furthermore, we have set up procedures that ensure that the rights of data subjects are exercised, that data is deleted and that data is reacted to when it is at risk. Furthermore, we already take the protection of personal data into account during the development or selection of hardware, software and processes, in accordance with the principle of data protection through technology design and through data protection-friendly default settings (Art. 25 DS-GVO).

3.2. The security measures include, in particular, the encrypted transmission of data between your browser and our server.

4. Zusammenarbeit mit Auftragsverarbeitern und Dritten

4.1. Sofern wir im Rahmen unserer Verarbeitung Daten gegenüber anderen Personen und Unternehmen (Auftragsverarbeitern oder Dritten) offenbaren, sie an diese übermitteln oder ihnen sonst Zugriff auf die Daten gewähren, erfolgt dies nur auf Grundlage einer gesetzlichen Erlaubnis (z.B. wenn eine Übermittlung der Daten an Dritte, wie an Zahlungsdienstleister, gem. Art. 6 Abs. 1 lit. b DS-GVO zur Vertragserfüllung erforderlich ist), Sie eingewilligt haben, eine rechtliche Verpflichtung dies vorsieht oder auf Grundlage unserer berechtigten Interessen (z.B. beim Einsatz von Beauftragten, Webhostern, etc.).

4.2. If we commission third parties to process data on the basis of a so-called "order processing contract", this is done on the basis of Art. 28 DS-GVO.

5. Transfers to third countries

If we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or this happens as part of the use of third-party services or disclosure or transmission of data to third parties, this only takes place if it is to fulfill our (pre)contractual obligations, on the basis of your consent, on the basis of a legal obligation or on the basis of our legitimate interests. Subject to legal or contractual permissions, we only process or have the data processed in a third country if the special requirements of Art. 44 ff. DS-GVO are met. This means that the processing takes place, for example, on the basis of special guarantees, such as the officially recognized determination of a data protection level corresponding to that of the EU (e.g. for the USA through the "Privacy Shield") or compliance with officially recognized special contractual obligations (so-called "standard contractual clauses").

6. Rights of data subjects

6.1. You have the right to request confirmation as to whether the data in question is being processed and to request information about this data as well as further information and a copy of the data in accordance with Art. 15 DS-GVO.

6.2. You have accordingly. Art. 16 DS-GVO the right to request the completion of the data concerning you or the correction of incorrect data concerning you.

6.3. In accordance with Art. 17 GDPR, you have the right to demand that the data in question be deleted immediately, or alternatively, in accordance with Art. 18 GDPR, to demand that the processing of the data be restricted.

6.4. Sie haben das Recht zu verlangen, dass die Sie betreffenden Daten, die Sie uns bereitgestellt haben nach Maßgabe des Art. 20 DS-GVO zu erhalten und deren Übermittlung an andere Verantwortliche zu fordern.

6.5. Sie haben ferner gem. Art. 77 DS-GVO das Recht, eine Beschwerde bei der zuständigen Aufsichtsbehörde einzureichen.

7. Right of Withdrawal

You have the right to revoke your consent in accordance with Article 7 (3) GDPR with effect for the future.

8. Right to Object

You can object to the future processing of data relating to you at any time in accordance with Art. 21 GDPR. The objection can be made in particular against processing for direct advertising purposes.

9. Erhebung von Zugriffsdaten und Logfiles

9.1 We collect data on every access to the server on which this service is located (so-called server log files) on the basis of our legitimate interests within the meaning of Article 6 (1) (f) GDPR. The access data includes the path of the accessed website, associated files, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user's operating system, referrer URL (the previously visited page), IP address and the requesting provider as well as other browser header data.

9.2 Log file information is stored for security reasons (e.g. to clarify misuse or fraud) for a period of 6 months and then deleted. Data whose further storage is required for evidence purposes are excluded from deletion until the respective incident has been finally clarified. In principle, this data will not be passed on to third parties unless it is necessary to pursue our claims or there is a legal obligation to do so in accordance with Article 6 (1) (c) GDPR.

10. Analysis, Tracking, Optimization

We provide technologies from us or from third parties that are not only used to provide a function within our online offer, but also serve exclusively or additionally to analyze user behavior, tracking, optimizing our marketing activities or other purposes mostly in our cookie policy.

12. Deletion, anonymization and retention of data

12.1. Die von uns verarbeiteten Daten werden nach Maßgabe des Art. 17 DS-GVO gelöscht. Sofern nicht im Rahmen dieser Datenschutzerklärung ausdrücklich angegeben, werden die bei uns gespeicherten Daten gelöscht, sobald sie für ihre Zweckbestimmung nicht mehr erforderlich sind und der Löschung insbesondere keine gesetzlichen Aufbewahrungspflichten entgegenstehen. Sofern die Daten nicht gelöscht werden, weil deren Verarbeitung für andere und gesetzlich zulässige Zwecke erforderlich ist, wird die Verarbeitung eingeschränkt. Das bedeutet, die Daten werden gesperrt und nicht für andere Zwecke verarbeitet.

12.2. Anstelle einer Löschung Ihrer Daten werden wir diese ggf. in einer Art und Weise anonymisieren, dass eine Widerherstellbarkeit der Personenbeziehbarkeit unumkehrbar für die Zukunft ausgeschlossen ist.

12.3 Nach den gesetzlichen Vorgaben erfolgt eine Aufbewahrung insbesondere für 6 Jahre gem. § 257 Abs. 1 HGB (Handelsbücher, Inventare, Eröffnungsbilanzen, Jahresabschlüsse, Handelsbriefe, Buchungsbelege, etc.) sowie für 10 Jahre gem. § 147 Abs. 1 AO (Bücher, Aufzeichnungen, Lageberichte, Buchungsbelege, Handels- und Geschäftsbriefe, Für Besteuerung relevante Unterlagen, etc.).

13. Provision of contractual services

13.1. We process inventory data (e.g. salutation, first and last name, title, residential address or company address) as well as contract data (e.g. subject matter of the contract, user name or payment information) for the purpose of fulfilling our contractual obligations and services in accordance with Article 6 Paragraph 1 lit. b GDPR . The information marked as mandatory in online forms is required for the conclusion of the contract.

13.2. As part of the provision of our contractual obligations and services - especially in the context of ticketing - we generally create user accounts. In particular, the user accounts enable you to view the orders you have placed. As part of the registration, you will be informed of the required mandatory information. The user accounts are not public and cannot be indexed by search engines. As part of the deletion of your user account (see No. 13.3. below), we will irretrievably remove all data stored by you or by us during the contract period from all systems. It is therefore your responsibility to back up your data upon termination or before the 3 years have expired.

13.3. Your user account and all the data it contains (e.g. order data) will generally be deleted after 3 years after registration or at any time after you have given notice of termination, apart from the deletion there are storage obligations for commercial or tax reasons in particular in accordance with Article 6 (1) lit c DS-GVO.

13.4 Im Rahmen der Registrierung und erneuten Anmeldungen sowie Inanspruchnahme unserer Onlinedienste speichern wir Ihre IP-Adresse und den jeweiligen Zeitpunkt der Handlung für 6 Monate. Die Speicherung dieser Daten erfolgt auf Grundlage unserer und Ihrer berechtigten Interessen zum Nachweis der jeweiligen Handlung und zum Schutz vor Missbrauch und sonstiger unbefugter Nutzung. Nach Ablauf von 6 Monaten löschen wir diese Daten. Sollte die weitere Aufbewahrung dieser Daten zu Beweiszwecken erforderlich sein, sind diese Daten bis zur endgültigen Klärung des jeweiligen Vorfalls von der Löschung ausgenommen. Eine Weitergabe dieser Daten an Dritte erfolgt grundsätzlich nicht, außer sie ist zur Verfolgung unserer Ansprüche erforderlich oder es besteht hierzu eine gesetzliche Verpflichtung gem. Art. 6 Abs. 1 lit. c DS-GVO.

14. Messe- bzw. Veranstaltungsbesuch, Überwachung Gelände, Aufnahmen (außerhalb des Onlineangebotes)

14.1. Film, television and photo recordings are usually made at trade fairs and other events. The data is processed on the basis of our legitimate interests in accordance with Article 6 Paragraph 1 Letter f) GDPR (public relations/marketing purposes). The recordings may be published to present our activities on our websites and in social media channels and/or in print media. We will provide you with further information on the respective processing - if necessary - on the day of the respective trade fair or event or in individual cases in advance.

14.2. Bei Messen und sonstigen Veranstaltungen setzen wir auf dem Gelände üblicherweise Überwachungskameras mit Aufnahmefunktion ein. Die erfolgten Aufnahmen speichern wir. Die Aufnahmen werden nur so lange gespeichert, wie sie für die nachgenannten Zwecke benötigt werden. Vorliegend werden die Daten nach Ablauf einer Frist von 72 Stunden – nach 3 Tagen – gelöscht. Die Verarbeitung erfolgt gem. § 4 Abs. 1 Satz 1 Nr. 2 und 3 BDSG oder ggf. gem. Art. 6 Abs. 1 lit. f) DS-GVO im Rahmen der Wahrnehmung unseres Hausrechts bzw. zur Wahrung unserer berechtigten Interessen oder soweit sie zur Erfüllung einer rechtlichen Verpflichtung erforderlich ist, der wir unterliegen (vgl. Art. 6 Abs. 1 lit. c) DS-GVO, z.B. zur Beweismittelsicherung). Die Verarbeitung gem. § 4 Abs. 1 Satz 1 Nr. 2 und 3 BDSG erfolgt gem. § 4 Abs. 1 Satz 2 Nr. 1 BDSG zum Schutz von Leben, Gesundheit oder der Freiheit der auf dem Gelände befindlichen Personen (Besucher). Weiterhin haben wir ein berechtigtes Interesse an der Abschreckung von möglichen Straftätern sowie an der Sicherung von Beweismitteln für den Fall einer versuchten oder vollendeten Straftat zu unseren Lasten oder zu Lasten eines Besuchers. Es besteht daher ein berechtigtes Interesse an der Vorbeugung und ggf. Verfolgung von Straftaten. Weitere Informationen zur jeweiligen Verarbeitung werden wir Ihnen – soweit notwendig – am jeweiligen Messe- bzw. Veranstaltungstag oder im Einzelfall auch schon vorab zur Verfügung stellen.

14.3 Wir halten auf dem Gelände stets eine – ggf. auch mehrere – Überwachungskamera(s) vor, die jedoch keine Aufnahmefunktion hat (haben). Die Bilddaten der Aufnahmen werden in Echtzeit auf einen Monitor in der Brandschutzzentrale übertragen (Kamera-Monitor-Prinzip), der diese Daten lediglich – d.h. ohne Speichermöglichkeit – abspielt. Eine Aufzeichnung bzw. Speicherung der Bilddaten findet daher nicht statt. Die Verarbeitung erfolgt gem. Art. 6 Abs. 1 lit. d) DS-GVO zum Schutz lebenswichtiger Interessen der auf dem Gelände befindlichen Personen (Erkennen von Bränden). Dafür halten wir ein Brandschutzkonzept vor, welches u.a. eine Echtzeitvideoüberwachung zum Erkennen von Bränden vorsieht. Die Verarbeitung erfolgt außerdem gem. § 4 Abs. 1 Satz 1 Nr. 3 BDSG zur Wahrnehmung berechtigter Interessen, dass bedeutet insbesondere zum Schutz von Leben und Gesundheit der auf dem Gelände befindlichen Personen (vgl. § 4 Abs. 1 Satz 2 Nr. 1 BDSG). Weitere Informationen zur jeweiligen Verarbeitung werden wir Ihnen – soweit notwendig – am jeweiligen Messe- bzw. Veranstaltungstag oder im Einzelfall auch schon vorab zur Verfügung stellen.

15. Contact

If you do not wish to receive such recommendations from us by e-mail, you can object to the use of your address for this purpose at any time without incurring any costs other than the transmission costs according to the basic rates. A message in text form is sufficient for this. Of course, each e-mail always contains an unsubscribe link.

16. Integration of share buttons for sharing content in social networks

We do not use any social plug-ins from social networks that collect data on our websites. In order to enable the uncomplicated sharing of content on our websites in social media, the so-called Shariff solution is used for our share buttons (further information on this can be found at: https://www.heise.de/ct/artikel/ Shariff-Social-Media-Buttons-mit-Datenschutz-2467514.html).

Damit wird verhindert, dass Daten unserer Nutzer ohne ihr Wissen an soziale Netzwerke weitergegeben werden, wenn sie unsere Webseiten aufrufen. Die Share-Buttons entsprechend der Shariff-Lösung stellen ausschließlich auf Anforderung – d.h. erst nach einem Klick des Nutzers auf einen Share-Button – eine Verlinkung zu dem entsprechenden sozialen Netzwerk her. Der Nutzer kann dann unter der Voraussetzung, dass er bei dem entsprechenden sozialen Netzwerk angemeldet ist, die Inhalte unserer Webseiten mit anderen Nutzern teilen. Dieser Prozess ist bei jedem sozialen Netzwerk etwas anders ausgestaltet. Nach einem Klick auf den Share-Button werden die zu teilenden Inhalte sowie die IP-Adresse und die allgemeinen Header-Informationen des Browsers des Nutzers an das jeweilige soziale Netzwerk übermittelt. Wir weisen darauf hin, dass wir keine Kenntnis vom Inhalt der im weiteren Verlauf übermittelten (personenbezogenen) Daten sowie deren Nutzung durch die sozialen Netzwerke haben.

17.1. 17.3 Wir weisen darauf hin, dass Ihre Daten durch den jeweiligen Betreiber auch außerhalb der Europäischen Union oder des europäischen Wirtschaftsraums verarbeitet werden können. Infolgedessen können sich Risiken für Sie ergeben, insbesondere kann die Rechte-Durchsetzung erschwert werden. In Bezug auf US-amerikanische Betreiber, die unter dem EU-US-Privacy-Shield zertifiziert sind, weisen wir zudem darauf hin, dass diese sich damit auch der Einhaltung von EU-Datenschutzstandards verpflichtet haben.

18. Links

We do not use any social plug-ins from social networks that collect data on our websites. If we do not use the Shariff solution, we only set links to social networks on our websites. This prevents our users' data from being passed on to social networks without their knowledge when they visit our websites. The links create a connection to our online presence of the respective social network only upon request - therefore only after the user clicks on a link. After clicking on the link, the IP address and the general header information of the user's browser are transmitted to the respective social network. The respective social network can collect further data as soon as you use its offers.
